By accessing or using FileToText at https://filetotext.ai ("Service," "we," "us," or "our"), operated by Supreme Ventures B.V., Amsterdam, the Netherlands, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

2. Description of Service

FileToText is an AI-powered transcription service that converts audio and video files into text. Our Service allows users to:

  • Upload audio or video files (or submit direct links to media files) for transcription
  • Receive AI-generated transcripts with speaker labels and timestamps
  • Play back media alongside the transcript and edit the text
  • Access transcription history in their account
  • Download transcripts in various formats (such as TXT, DOCX, SRT, and VTT)

3. User Accounts

3.1 Account Creation

  • A free account is required to use the Service; you can sign in with Google, Apple, or email
  • Account creation requires providing accurate and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 13 years old to create an account

3.2 Account Responsibilities

  • You are responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

  • Violate any applicable laws or regulations
  • Submit content containing:
    • Hate speech, harassment, or discriminatory content
    • Violence, threats, or harmful content

5. Content and Copyright

  • We respect the intellectual property rights of content creators
  • Transcribing copyrighted content may require permission from the copyright holder
  • You are responsible for ensuring your use complies with copyright and recording-consent laws in your jurisdiction

If you believe your copyrighted work has been infringed through our Service:

6. Service Availability and Limitations

6.1 Service Availability

  • We strive to maintain high uptime but do not guarantee uninterrupted service

  • We reserve the right to modify, suspend, or discontinue the Service at any time

6.2 Usage Limits

  • Free accounts receive a free transcription allowance (currently the first 10 minutes of a file); limits may apply to length, frequency, or features
  • Paid users receive the minutes included in their purchase or subscription plan
  • We may implement rate limiting to ensure fair usage

6.3 Accuracy Disclaimer

  • Transcriptions are generated using AI and may contain errors
  • We do not guarantee 100% accuracy of transcriptions
  • Users should review and verify transcriptions for their intended use

7. Payment and Subscription

7.1 Paid Options

  • Beyond the free allowance, transcription minutes are available as one-off pay-as-you-go purchases or through subscription plans, as outlined on our pricing page
  • Payments are handled by Stripe, which acts as the merchant of record for your purchase and handles applicable taxes

7.2 Satisfaction Guarantee (Refunds)

  • If you are not satisfied with a transcript, we will refund your purchase in full. No questions asked
  • To claim a refund, email info@filetotext.ai from your account email address (or reply to any email we sent you). No forms, no proof required
  • Refunds are issued to the original payment method via Stripe
  • A short note on what went wrong helps us improve, but it is entirely optional

7.3 Billing

  • Subscription fees are billed in advance on a recurring basis
  • Usage beyond a plan's included minutes may be billed as metered overage, as shown on the pricing page
  • You authorize us to charge your payment method for applicable fees
  • Failed payments may result in service suspension

7.4 Cancellation

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period

8. Privacy and Data

8.1 Privacy Policy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8.2 Data Processing

  • Submitted files and transcripts are stored in your account so you can revisit, play back, edit, and export them

  • We do not claim ownership of your transcriptions or submitted content

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10.3 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

11. Termination

You may stop using our Service at any time and delete your account if you have one.

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
